Payment Terms and Billing
Subscription fees of $250 per month are billed in advance and automatically charged to your nominated payment method. All prices include GST where applicable.
Payment processing fees may apply depending on your chosen payment method. Subscription can be cancelled with 30 days notice.
Termination of Services
Either party may terminate this agreement under the following circumstances.
- You may cancel your subscription at any time with 30 days written notice
- We may suspend services for non-payment after reasonable notice and opportunity to cure
- Either party may terminate immediately for material breach of these terms
Service Disclaimers
Our financial planning services are provided for informational and consultation purposes only and do not constitute specific financial advice for your individual circumstances.
Services are provided "as is" without warranties of any kind, either express or implied.
Limitation of Liability
To the maximum extent permitted by Australian law, our liability is limited to the amount of subscription fees paid by you in the 12 months preceding any claim.
Maximum liability is capped at $3,000 per client per incident.
Alternative Dispute Resolution
We are committed to resolving any disputes fairly and efficiently through the following mechanisms.
Internal Resolution Process
We encourage clients to contact us directly to resolve any concerns or disputes before pursuing external remedies.
Disputes will first be addressed through good faith negotiations between you and our management team.
External Dispute Resolution
If internal resolution is unsuccessful, disputes may be referred to the Australian Financial Complaints Authority.
AFCA provides free independent dispute resolution services for financial service complaints.
Governing Law and Jurisdiction
These terms are governed by Australian law and the laws of the state or territory where our services are provided. Australian courts have jurisdiction over any disputes.
Changes to These Terms
We may modify these terms from time to time to reflect changes in our services or legal requirements.
We will provide at least 30 days notice of material changes via email or website notification.
Entire Agreement
These Terms and Conditions, together with our Privacy Policy, constitute the complete agreement between you and Evarinthosa regarding our services.
